1. User Responsibilities for AI-Generated Content

As a user of our AI image generation service, you accept full responsibility for the content you create using our platform. By using our service, you agree:

• Not to generate images depicting nudity, pornography, or sexually explicit content
• Not to generate images depicting violence, gore, or illegal activities
• Not to generate images that infringe on copyrighted material or trademarks
• Not to generate images of real individuals without their explicit consent
• Not to generate images that promote discrimination, hate speech, or harmful stereotypes
• Not to generate images of minors in inappropriate contexts
• Not to generate images for deceptive purposes (e.g., deepfakes to impersonate others)
• Not to use generated images for fraud, scams, or any illegal activities

GetANewPic reserves the right to moderate and remove content that violates these guidelines. Repeated violations may result in account suspension or termination without refund.

2. Data Storage & Usage

User-uploaded photos and AI-generated images are stored for the duration of your account. Upon account deletion, all associated images are deleted after a 30-day buffer period. User-uploaded photos are used to train our AI models to improve our service. By uploading photos, you grant us permission to use these images for AI training and service improvement purposes.

3. Content Moderation

GetANewPic employs automated content filters to prevent generation of prohibited content. However, these systems may not be perfect. If you receive content that violates our guidelines, please report it immediately to contact@getanewpic.com. We reserve the right to monitor generated content to ensure compliance with these terms and applicable laws.

4. AI Technology Limitations

You acknowledge that our AI technology has limitations and may occasionally produce unexpected or imperfect results. Generated images may contain artifacts, distortions, or other imperfections. We are continuously improving our technology but cannot guarantee perfect results in every case.

5. Image Rights

Users retain ownership of AI-generated images created through our service. However, by using our service, you grant GetANewPic a limited, non-exclusive license to store, process, and display the images for operational purposes only. You are responsible for ensuring you have the rights to use any uploaded source images.

While you own the generated images, you acknowledge that similar images may be generated for other users due to the nature of AI systems. GetANewPic does not guarantee exclusivity of generated content.

6. Refund Policy

Failed Generations (No Image Output): Credits will be refunded or reinstated if deducted without result delivery.
Misfigured/Deformed Images: Due to the experimental nature of AI, no refunds for unsatisfactory images that comply with the generation request.
Content Violations: No refunds will be provided for attempted generation of prohibited content.
All refunds are evaluated case-by-case.

7. Usage & Limitations

Usage is based on purchased credits. We reserve the right to implement reasonable usage limits to prevent abuse of the service and ensure fair access for all users.

8. Intellectual Property Infringement

GetANewPic respects intellectual property rights and expects users to do the same. If you believe content generated through our service infringes on your intellectual property rights, please submit a notice to copyright@getanewpic.com with details of the alleged infringement. We will promptly investigate and take appropriate action.

9. Age Restrictions

Our service is not intended for users under 13 years old. Parental consent is required for minors where applicable by law.

10. Limitation of Liability

To the maximum extent permitted by law, GetANewPic shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use the service, including but not limited to loss of profits, data, or business opportunities.

11. Updates to Terms

We may update these terms periodically. Changes will be communicated via email. Your continued use of the service after such changes constitutes acceptance of the updated terms.
